Zuptly ("we", "us") is operated by Zuptly LLC. Zuptly monitors HTTP endpoints, SSL certificates, DNS records, and domain expiry that you configure, and sends you email alerts (and, as we add channels, other notification types) when something changes or fails. Zuptly is offered on Free, Starter, and Pro plans as described at zuptly.com.
You create an account by signing in through our authentication provider (email/password or Google), which verifies your email address before your account is created. You're responsible for the monitors you configure and for keeping your account credentials secure. You must be at least 18 years old and legally able to enter into this agreement to use Zuptly.
Zuptly may only be used to monitor resources (URLs, domains, DNS records) that you own or are authorized to monitor. Don't use Zuptly's checks to attack, scan, or overload systems you don't control, and don't use the account email field to receive alerts for anyone other than the account holder. You will indemnify and hold harmless Zuptly LLC from claims, damages, and reasonable legal costs arising from your violation of this section or your use of the service to monitor resources you are not authorized to monitor.
Every alert email we send is transactional — triggered by a monitor you configured, sent only to the address on your account. We do not send marketing email. Every alert explains why you received it and how to stop future alerts of that kind (pause or delete the monitor). Separately from alerts, we may send administrative email about your account itself — for example payment problems, security notices, or material changes to these terms. To stop all mail permanently, or if you believe you received an alert in error, contact [email protected] and we'll take care of it.
Starter and Pro plans are billed monthly through Stripe and renew automatically each month until you cancel. You can upgrade, downgrade, or cancel at any time from your account; canceling takes effect at the end of the current billing period. We may change plan pricing with at least 30 days' notice by email; new prices apply from your first billing period after the notice period, and you can cancel before then if you don't agree. Fees are non-refundable except where required by law.
Check-result history is retained for 7 days on the Free plan, 90 days on Starter, and 1 year on Pro, after which older results are purged automatically. Your monitor configuration itself is kept until you delete it, or until your account is closed (see the Privacy Policy for how data is handled after closure).
You can close your account at any time by emailing [email protected]. We may suspend or terminate an account that violates these terms — with notice where practical, or immediately for serious abuse such as using checks against systems you don't control. We may also modify or discontinue the Free plan with reasonable notice. When an account is closed, its data is handled as described in the Privacy Policy.
Monitoring checks run on the interval you configure and can be delayed, missed, or affected by factors outside our control (network issues, third-party outages, email deliverability). Zuptly is a monitoring aid, not a guarantee of uptime, and should not be your only means of detecting an outage for anything critical.
Zuptly is provided "as is" and "as available" without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Zuptly LLC is not liable for indirect, incidental, special, or consequential damages arising from use of the service, including losses caused by a missed or delayed alert. To the maximum extent permitted by law, Zuptly LLC's total aggregate liability for all claims arising out of or relating to the service is limited to the amount you paid us in the twelve months before the claim arose, or $100 if you are on the Free plan.
We may update these terms as the product changes. For material changes we'll email the address on your account and update the "Last updated" date above. Continued use of Zuptly after a change takes effect constitutes acceptance; if you don't agree to a change, close your account before its effective date.
These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the service will be resolved exclusively in the state courts located in Kane County, Illinois, or the federal courts of the Northern District of Illinois, and both parties consent to the jurisdiction of those courts. If any provision of these terms is found unenforceable, the remaining provisions stay in effect. These terms are the entire agreement between you and Zuptly LLC regarding the service. We may assign these terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our written consent. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control.
